Heard learned counsel for the parties.
Petitioner, a constable in civil police, came to be retired on attaining the age of superannuation on 31 January 2019.
It is urged by learned counsel for the petitioner that a criminal case is pending against the petitioner before the competent court. Further, petitioner is entitled to provisional pension in terms of sub-clause (3) to Article 919-A of the Civil Service Regulations.
Learned Standing Counsel submits that the third respondent shall pass appropriate order on the representation of the petitioner to release the provisional pension.
In view thereof, on consent, the petition is disposed of at this stage directing the third respondent, Senior Superintendent of Police, Etah, to consider and decide the representation of the petitioner, by a reasoned and speaking order, expeditiously, preferably, within two months from the date of filing of certified copy of this order along with the copy of the writ petition.
It is clarified that the Court has not considered the claim of the petitioner on merits.
