Learned counsel for the petitioner prays to withdraw this petition with liberty to file a fresh petition by enclosing therewith copy of the plaint and copy of the trust/endowment deed.
The petition is dismissed with liberty as prayed for.
When a fresh petition is filed, the notice of the fresh petition shall be served upon the counsel for the caveator, who has appeared in these proceedings.
The certified copy of the enclosures shall be returned to the learned counsel for the petitioner upon furnishing photocopies thereof.
