Heard Sri Arvind Kumar, learned Counsel for the applicant, Sri Manish Tiwari, learned counsel for the respondent in connected matter, Sri A.R. Chaurasia, learned A.G.A. for the State and perused the material brought on record.
The present 482 Cr.P.C. petition has been filed for quashing the non bailable warrant dated 26.2.2013 to 23.12.2015 issued in Case No. 1283 of 2009 arising out of Case Crime No. 156 of 1990 under Sections 323, 342, 504 I.P.C., police station Dadri, District Gautambudh Nagar.
Learned counsel for the petitioner submits that the petitioner could not appear before the trial court due to some unavoidable circumstances.
After having heard the learned counsel for the parties present and perused the impugned order as well as the material brought on record, we are of the view that the impugned order is based upon relevant considerations and supported by cogent reasons, hence requires no interference by this Court. The prayer for quashing the same is hereby refused.
For a period of three weeks from today, non-bailable warrant issued against the applicants shall be kept in abeyance.
With the aforesaid observations, the application stands disposed of.
