Heard learned counsel for the petitioners and Shri Rajesh Kumar, learned Standing Counsel for State respondents.
The petitioners are before this Court for a direction to the respondents to ensure appropriate demarcation on the spot.
Shri Rajesh Kumar, learned Standing Counsel raised an objection that as per Section 24 of U.P. Revenue Code, 2006 as well as Rule 22 of U.P. Revenue Code Rules, 2016 there is full fledged mechanism provided for making appropriate application for demarcation and without submitting any such application in consonance with the aforesaid provisions, the petitioners straight away approached this Court merely on the basis of some report and as such no reprieve can be extended to the petitioners.
Confronted with this situation, learned counsel for the petitioners states that liberty may be accorded to the petitioners to move appropriate application in consonance with the aforesaid provisions.
Considering the facts and circumstances of the case, the writ petition stands disposed of with observation that in case any such application is moved before the concerned Sub Divisional Magistrate within two weeks, this Court hope and trust that the same would be considered and decided in accordance with law expeditiously but certainly after giving opportunity to the parties concerned.
