Learned Advocate for the petitioner is absent. Mr. Tolia, learned Advocate for the respondents is present. After briefly narrating the facts, Mr. Tolia has drawn attention to para 19 and 20 of the judgment and submitted there is no prima facie case against the accused/respondents.

It was also submitted that accused has filed any acquittal appeal as per instructions received Page 1 of 2 R/CR.RA/248/2007 ORDER by Mr. Tolia. Learned APP Shri Patel is submitted that he has verify that State has preferred any appeal or not.
