JUDGMENT / ORDER

Petitioners are accused in Crime No.426 of 2014 of the Kasaragod Police station for the offence punishable under Sec.395 of the Indian Penal Code, apprehend arrest and have filed the application. 2. Learned Public Prosecutor has opposed the application. It is submitted that with the assistance of the 2nd petitioner, some of the other accused in the case took videographs of the defacto complainant having sexual intercourse with two ladies and on the strength of that, threatened the defacto complainant and forcibly took Rs.17,000/- from him, his wrist watch and a mobile phone. They made a demand for Rs.30,00,000/-. The 2nd petitioner is involved in 8 other cases.
3. Learned counsel submitted that the allegations are not true. It is also submitted that as the petitioners 1 and 3 are already arrested, the request now is made on behalf of the 2nd petitioner alone.
4. Having regard to the circumstances of the Bail Appl. No. 3450 of 2014 2 case and the investigation required to be done, request for pre arrest bail cannot be allowed.
The application is dismissed.
