JUDGMENT / ORDER

Hon'ble Yogendra Kumar Sangal,J.
Heard learned counsel for the petitioner and learned AGA for the State.
Under challenge is FIR relating to Case Crime No. 39 of 2009, under Sections 498-A, 323, 504 506 IPC and 3/4 Dowry Prohibition Act, P.olice Station, Mahila Thana, district Sitapur. We have gone through the contents of the FIR. It comes out that petitioner happens to be Uncle of Chand Babu, husband of respondent no. 3 and is living seperately.
Argument advanced by the learned counsel for the petitioner is that petitioner has got nothing to do with respect of demand od dowry. Only with the purpose of harassment, name of the petitiner has been involved in the FIR.
Issue notice to opposite party No. 3 returnable at an early date. Respective opposite parties may file their counter affidavit within six weeks. Rejoinder affidavit, if any, may be filed by the petitioners within next two weeks.
List after expiry of the aforesaid period.
However, till the next date of listing, petitioner shall not be arrested in the aforesaid case crime number provided he cooperates with the investigation, which shall go on.
