Heard learned counsel for the petitioner and learned Standing Counsel for the State.
By way of this writ petition, the petitioner has prayed the following prayers:-
"(a) Issue a writ, order or direction, in the nature of mandamus directing the court of Arbitrator/Commissioner, Kanpur Region, Kanpur Nagar to decide the objection Suit No. 646 of 2020 (Shambhu Singh Katiyar Vs. Competent Authority and others) within stipulated period as fixed by this Hon'ble Court."
The prayer prayed for is not as such which cannot be granted by this Court hence, the same is granted in part.
Accordingly, the writ petition is disposed of with a direction to the court of Arbitrator/Commissioner, Kanpur Region, Kanpur Nagar to decide the objection Suit No. 646 of 2020 (Shambhu Singh Katiyar Vs. Competent Authority and others), as per the limitation prescribed under law.
This Court has not expressed any opinion on the merit of the case.
