Shambhu Nath Pandey vs Civil Judge (S.D.) Jaunpur & Anr.

High Court Of Judicature at Allahabad|04 January, 2010

JUDGMENT / ORDER

Petitioner Counsel :- L.S. Tripathi Hon'ble Krishna Murari, J.
Aggrieved by the refusal of the trial court to grant ex parte temporary injunction and only issuing notices, the petitioner has approached this Court.
A perusal of the order indicates that while issuing notices, the trial court has fixed 23.12.2009 for disposal of the temporary injunction application.
Learned counsel for the petitioner states that the matter was adjourned on 23.12.2009 because the notices could not be issued. Considering the facts and circumstances, the writ petition stands disposed of with the direction to the Civil Judge, Junior Division, Jaunpur to pass appropriate orders on the application for temporary injunction filed by the plaintiffpetitioner in Suit No. 1191 of 2009 by means of a reasoned and speaking order after notice and opportunity of hearing to all concern within a period of six weeks from the date of production of a certified copy of this order before him.
