Heard Sri Manu Saxena, learned counsel for the petitioners and learned Standing Counsel for respondents State. Sri Azad Rai, learned counsel has accepted notice on behalf of Gaon Sabha.
It is contended that by an ex-parte order dated 29.10.2020, proceedings under Section 33/39 of the L.R. Act, name of petitioners have been expunged from revenue records.
As the petitioners have remedy of filing an application for recall against an ex-parte order under Section 209 (h) of the U.P. Revenue Code, 2006, writ petition is not maintainable.
However, it is provided that in case petitioners approach appropriate authority by filing a recall application within 15 days along with copy of this order downloaded from the official website of this Court, concerned revenue authority shall not go into the question of limitation and shall decide the same strictly in accordance with law.
Writ petition stands disposed of.
