Heard Sri Dhiraj Kumar Pandey, learned counsel for the petitioners and Sri Ashish Upadhyay, learned Standing Counsel.
The petitioners have stated in the writ petition that they have got married and there is threat to their lives. Thus, they sought protection from this Court.
Sri Sunil Kumar Mishra, Advocate states that he is representing first wife of petitioner no. 2 whose name is Indu. He contends that she is not made a party and the petitioners have not come up with clean hands inasmuch as, petitioner no. 2 has stated in the writ petition that this is his first marriage, whereas this is his second marriage. This material fact has not been disclosed by the petitioners.
Being confronted with the aforesaid fact, learned counsel for the petitioners on instructions of his client states that this is the second marriage of petitioner no. 2.
Since, the petitioners have not come up with clean hands and has tried to mislead the Court to obtain order in favour of the petitioners, therefore, it is a fit case for imposing a cost of Rs.10,000/- upon the petitioners which shall be deposited the with the Legal Services Authority.
The writ petition is dismissed.
