The petitioner-appellant has not been selected in the UPTET- 2018 as her answer book in Language-II was not examined on account of not filling up the OMR sheet properly.
The learned Single Judge has dismissed the writ petition in view of the decision of the Supreme Court in the case of Karnataka Public Service Commission and Ors. Vs B.M. Vijaya Shankar and Ors. reported in AIR 1992 SC 952. Thus, this appeal has been preferred.
We find no merit in this appeal as the petitioner-appellant who was a candidate in a public examination was unable to fill up even the OMR sheet correctly, which she did at her own risk and is accordingly not a person fit enough to be selected on this very ground.
In view of the above, the appeal is dismissed.
