Heard learned counsel for the applicant, learned A.G.A. and perused the record.
The instant application is being moved by the applicant namely, Shalini Sahai invoking the powers of Section 438 Cr.P.C. that she has every reason to believe that she may be arrested on the accusation of having committed a non-bailable offence in connection with Case Crime no. 317A of 1998, under Section 306 subsequently converted into section 302 and 201 of IPC, Police Station- Rakabganj, District- Agra.
Since the matter has been converted from section 306 IPC to 302 and 201 IPC and in this addition, charge sheet has also been submitted. Therefore, the present anticipatory bail application is not maintainable in the light of section 438 (6) (i)(b) of the (U.P. Amendment Act No. 4 of 2019), accordingly the same is REJECTED.
