The applicant is before this Court for a direction to initiate contempt proceeding against the opposite party for wilful disobedience of the order dated 18.01.2021 passed in Writ A No. 290 of 2021 (Shakuntala Devi and 2 Others Vs. State of U.P. and Others), which for ready reference is quoted as under:-
"The grievance of the petitioners appears to be non-release of his salary for the period between 30.06.2015 to 31.03.2016 and non-payment of retiral dues together with interest. In that regard, the petitioners further appear to have retired from service and moved representation on 14.03.2019 and 24.04.2019 (Annexure-5 to the writ petition) which are stated to be pending before the respondent no. 4.
In view of the above, no useful purpose would be served in keeping this petition pending or calling for a counter affidavit.
Writ petition is disposed of with the observation that in case the petitioners file a copy of this order before the respondent no. 4, the said authority shall proceed to decide the aforesaid representations pending before him as expeditiously as possible preferably within a period of three months from the date of production of a copy of this order before him."
Pursuant to the aforesaid order, the letter dated 02.03.2021 was written by the District Basic Education Officer, Agra to Finance and Account Basic Education, Agra, copy of which is appended as Annexure-7 to the present petition.
It is informed by the counsel for the applicants that order passed by the writ court has not yet been complied with.
In the facts and circumstances, the opposite party is directed to comply with the order passed by this Court and file an affidavit of compliance on or before 06.09.2021.
Counsel for the applicant is directed to submit a copy of this order along-with copy of representation annexing all the relevant documents and papers specially order dated 18.01.2021 as well as order dated 02.03.2021 in the office of the opposite party within a week. If such representation is made, opposite party is directed to comply with the order passed by the writ court.
Put up as fresh on 06.09.2021.
In case, the order passed by the writ court has not been complied with in its letter and spirit, the opposite party shall remain present before this Court on the next date fixed in the matter.
