The instant writ petition is directed against the order dated 7.4.2018, by which the Principal, District Institute of Education & Training (DIET), Etah has attached D.El. Ed. trainees of the petitioner institute with another institute namely, Smt. Dhoopkali Lala Ram College, G.T. Road, Aaspur, Etah. The said arrangement has been made on the basis of complaint made by the trainee students in regard to unauthorised realisation of money by the petitioner. It is not disputed before this Court that practical exam of the students is to commence from coming Monday, i.e., 4 June 2018.
Having regard to the nature of allegation against the petitioner institute and the fact that practical exam is to commence from Monday, 4 June 2018, this Court is not inclined to interfere with the impugned order, although submission of learned counsel for the petitioner is that it has been passed without notice or opportunity of hearing to it. However, at the same time, the Principal, DIET, Etah, who has passed the order, is directed to afford post decisional hearing to the petitioner institute.
Counsel for the petitioner states that the petitioner will represent before respondent no.4 within two days. In the event, representation is made by the petitioner institute as stated above, the same shall be decided by the fourth respondent within next two weeks. The impugned arrangement shall abide by the decision which would be taken by respondent no.4 on the representation of the petitioner.
The writ petition stands disposed of accordingly.
