1. Learned counsel for revisionist submitted that against an order passed by Special Chief Judicial Magistrate, Agra under Section 156(3) Cr.P.C. for registering First Information Report under Section 387 I.P.C. where against police lodged First Information Report on 06.03.2003 and submitted charge sheet on 25.03.2003.
2. In the meantime, accused filed revision against Magistrate's order passed under Section 156(3) which was allowed by revisional Court on 02.06.2003 and order under Section 156(3) was set aside. As a result whereof Magistrate passed a fresh order directing Investigating Officer not to proceed with investigation but since investigation was concluded by Investigating Officer and charge sheet was submitted before Special Judge (DAA) Agra, who therefore, proceeded with the matter and the revisionist's application for discharge has been rejected.
3. It is contended that charge sheet is itself without jurisdiction. When Court required counsel for revisionist to show any law, he prays for some time to bring the same.
