This writ petition has been filed quashing the impugned First Information Report dated 12.3.2013 registered as Case Crime No. 229 of 2013 under Section 13 (1) (E), 13 (2) of Anti Corruption Act, 1988, Police Station Siddhartha Nagar, District Siddhartha Nagar and for a direction to the respondents not to arrest the petitioner in pursuance of impugned First Information Report.
Learned counsel for the petitioner, in support of his submission and relief, placed reliance on paragraph 17 of the writ petition, which reads as under:-
"17.That first information report was lodged against the petitioner in year 2013 and more than 8 years chargesheet has not been filed in the concerned court and investigation is still going on, therefore, a first information report is liable to quashed on the ground of long investigation."
On the basis of instructions, Shri Arunendra Kumar Singh, learned A.G.A. submits that the investigation has already been completed and prosecution sanction has also been accorded by the State Government. He further submits that chargesheet has been prepared and very soon, the same shall be transmitted to the court concerned.
Confronted with this situation, learned counsel for the petitioner states that he does not wants to press the writ petition and the the same may be dismissed as not pressed.
Consequently, the writ petition is dismissed as not pressed.
