Heard learned counsel for the petitioner.
Only prayer made in the present petition is to issue a direction to the Court below to decide the temporary injunction (6C) application within stipulated period.
The petitioner is defendant no. 1 and has filed written statement on his behalf and on behalf of the contesting defendant no. 2. He is aggrieved by the order of extension of interim injunction in favour of the plaintiff on account of pendency of the temporary injunction matter.
Be that as it may, having perused the order sheet, without expressing any opinion as to the merits of claim of the petitioner, the present petition is being disposed of with the direction to the Court below namely the Civil Judge (Junior Division), Chandauli to decide the temporary injunction (6C) application pending in Suit No. 104 of 2017 (Deewan Mohd. Liyakat Husain vs. Shakeel Ahmad and others), preferably, on the next date fixed or on a short date to be fixed within a further period of four weeks, thereafter.
