JUDGMENT / ORDER

Heard learned counsel for the petitioners.
After some argument Sri Kshitij Shailendra, learned counsel for the petitioners confines his prayer only to the extent to direct the Waqf Tribunal-respondent no.1 to decide the application under Order VII Rule 11 CPC itself filed in Suit No.115 of 2016 expeditiously.
This prayer has not been objected by Sri Punit Kumar Gupta, learned counsel appearing on behalf of respondent no.2.
Heard learned counsel for the parties and perused the record.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the respondent no.1 to consider and decide the aforesaid application in accordance with law on the next date fixed in the matter after hearing all the parties concerned. If on account of any reason no orders were passed on the aforesaid date, the decision will be taken on the aforesaid application preferably within a period of three month, thereafter.
