Heard Sri S.K.Dubey, learned counsel for the petitioner, Sri N.K.Verma, learned A.G.A. for the State and perused the impugned FIR as well as material brought on record.
This petition has been filed by the petitioner with a prayer to direct the respondent nos. 2 and 3 to conclude the fair investigation in pursuance of the order dated 17.3.2018 passed by Special Judge, POCSO Act/Additional Sessions Judge, Court No.7, Ghaziabad in pursuance of the FIR dated 8.2.2016, registered as case crime No.48 of 2016, under Section 354(A), 34 I.P.C. and 7/8/17 POCSO Act, P.S. Link Road, District Ghaziabad.
It has been contended by learned counsel for the petitioner that petitioner is the informant of the present case. He further submitted that twice final report was submitted in the matter and lastly further investigation has been ordered on 17.3.2018 but the investigation has not been concluded, hence, he has come up before this Court with a prayer that direction be given to respondent no.2 and 3 for fair investigation in the matter as he apprehends that investigation is not being carried out in a fair and proper manner.He further submitted that.
Considering the facts and circumstances of the case and submissions advanced by learned counsel for the parties, we direct the Investigating Officer of the present case to conclude the investigation of the present case and submit a police report before the Magistrate concerned expeditiously preferably within a period of six weeks from the date of production of a certified copy of this order.
It is further directed that the S.S.P., Ghaziabad shall supervise the investigation and ensure that the same is completed speedly without any undue delay.
With the above directions this petition is finally disposed of.
