Application filed under Section 438 of the Code of Criminal Procedure.
2. Petitioners are accused Nos.1 to 3 in Crime No.588 of 2014 of the Poochackal Police Station registered for the offences punishable under Sections 143, 147, 341, 324 and 326 r/w Section 149 of the Indian Penal Code.
3. Petitioners had earlier approached this court for anticipatory bail in B.A.No.6232 of 2014 and considering the seriousness of the allegations against the petitioners the said application was dismissed.
4. The present request of the learned counsel for the petitioners is that the petitioners may be directed to surrender before the court below and move for bail. Of course, any such direction is not required. If so advised, the petitioners may surrender before the court below and seek bail. In such event, if notice is given in advance to the concerned Assistant Public Prosecutor in charge of the case, the court below shall dispose B.A.No.6915 of 2014 2 of the bail application preferably on the same day itself and pass appropriate orders.
With the above observation, this bail application is dismissed.
