JUDGMENT / ORDER

The petitioner herein is the sole accused in Crime No. 661/2012 of the Ezhukone Police Station of Kollam District, registered under Sections 294(b), 506(i) and 509 of IPC on the complaint of one Remanan. The petitioner seeks orders quashing the crime on the ground that he and the complainant have come to terms amicably out of court. The de facto complainant Remanan is the third respondent in this proceeding. It is submitted that there is a connected civil matter, and that the whole dispute stands resolved forever by mediation. Annexure A3 is the copy of the mediation agreement signed by the parties. I am well satisfied that there is a real settlement between the complainant and the petitioner, and that continuance of prosecution in the circumstances of settlement will do harm and hardship to both the parties. It is submitted that a counter case in Crime No.206/2013 stands already quashed. Crl. M.C No.6899 of 2014 2 In the result, this petition is allowed. The FIR and further proceedings in crime No.661/2012 of the Ezhukone police station will stand quashed under Section 482 Cr.P.C.
