Heard Ms. Rita Prajapati, learned counsel for the applicants and learned A.G.A. for the State The present application under Section 482 Cr.P.C. has been filed for staying the proceeding of Case No.1140 of 2017 under Sections 323, 504, 506, 379 IPC, P.S. Kotwali, District Ghazipur as well as the summoning order dated 3.4.2018 pending in the court of C.J.M.,Ghazipur.
Learned counsel for the applicants submits that the opposite party no.2 is the husband of the applicant no.1. It is further submitted that earlier applicant no.1 has initiated proceedings under Section 498-A and other allied section against her husband and in-laws and as a counter blast present proceedings have been initiated against the applicants only to put pressure, which is bad in law.
Notice on behalf of opposite party no.1 has been accepted by learned A.G.A.
Issue notice to opposite party no.2 returnable within four weeks at the address given in the application.
Opposite party no.2 may file counter affidavit within four weeks. Learned A.G.A. may also file counter affidavit within the same period. Rejoinder affidavit may thereafter be filed within two weeks.
List thereafter.
Till the next date of listing, further proceedings of the aforesaid case shall remain stayed.
