The petitioner has preferred this writ petition for a direction upon the respondent nos. 2 and 3 not to interfere in her possession in respect of her house which is constructed over Arazi No. 856.
Her grievance is that she has purchased the property apart of the property on 29.01.2016 from Smt. Usha Yadav wife of Sri Ram Singh, but the officials of the authority concerned are threatening for demolition apart of the house. No other grievance has been raised.
We have heard learned Standing Counsel and perused the material brought on record.
We find that the petitioner for redressal of her grievance has made a representation to respondent no.3 on 06.02.2018.
Having due regard to the facts and circumstances of the case, we are of the view that the ends of justice would be subserved by issuing a direction upon respondent no.2 to consider the grievance of the petitioner and pass the appropriate order in accordance with law expeditiously and grant opportunity to the petitioner to file fresh along with certified copy of this order within three weeks before respondent no.3.
We make it clear that we have not expressed our opinion. The merit of the case of the respondent no.3 shall pass independently in accordance with law.
With the aforesaid observation/direction, present petition stands disposed of.
