(Per : HONOURABLE MR.JUSTICE C.L. SONI) This application is moved with a prayer to appoint Pushpaben Shaileshkumar Thakore, wife of the applicant-appellant as legal guardian and next friend. It is stated in the application that originally the appeal was filed through the father of the original applicant Shri Natwarji Thakor. However, pending the appeal, father of the appellant passed away on 11.6.2011. It is stated that the appellant was totally bed-ridden and not in a position to take action on his own and therefore, the appeal was also required to be preferred through his father who was the legal guardian of the appellant.
In view of the above developments, we are inclined to allow this application and permit Pushpaben Shaileshkumar Thakore, wife of the applicant, original appellant to prosecute the appeal as legal guardian and next friend. Accordingly, this application is allowed and disposed of. Necessary amendment in title clause of the First Appeal shall be carried out within a period of four weeks from today.
