1. In view of office note dated 29.10.2012 submitted through Registrar (Judicial) in un-numbered paragraph No.3 it is stated as under:
"It is further submitted that in the above matter the A.N.Anjaria, 11th Additional District and Sessions Judge, Rajkot has stated that trail of the captioned Sessions Case was taken up on hand, But Mr. Ashok Dayabhai Kotecha, the son of the deceased, filed Petition for Special Leave to Appeal (CRL.) No.6421 of 2012 challenging the judgment and order dated 20.7.2012 of the High Court of Gujarat, Ahmedabad in Criminal Misc. Application NO.5744 of 2012 arising out of the judgment and order dated 17th February, 2012 of the 3rd Additional Sessions Judge, Rajkot in Sessions Case No.124 of 2009 with Criminal Miscellaneous Petition No.18177 of 2012, and by order dated 27.8.2012 passed in above SLP, the Hon'ble Supreme Court has ordered to stay further proceedings of trial of above sessions case."
2. In view of stay granted by the Apex Court direction contained in the order dated 13.4.2012 passed in Criminal Misc. Application No.13719 of 2011 will cease to have any effect.
3. Considering the above the office note is disposed of.
4. Criminal Misc. Application No.13719 of 2011 is adjourned to 14.12.2012.
