JUDGMENT / ORDER

1.0 Present application is filed through jail praying for Parole Leave for a period of 45 days so as to attend the agriculture work.
2.0 Rule.
Learned Additional Public Prosecutor Mr. HK Patel waives service of process of Rule.
3.0 Learned Additional Public Prosecutor made available for perusal the Jail Remarks. The convict has enjoyed Temporary Bail on three different occasions. He has enjoyed Parole on three occasions of which, the last is from 5th January 2012 to 26th January 2012 for the same purpose i.e. agriculture operations.
4.0 The ground made out for grant of Parole Leave is not found to be convincing. Hence, this application is rejected. Rule is discharged.
4.1 However, non-entertainment of this application for agriculture work may not be considered for grant of similar request if made at the appropriate time in the monsoon season.
