JUDGMENT / ORDER

Court No. - 4
Case :- CRIMINAL MISC. WRIT PETITION No. - 20118 of 2018 Petitioner :- Shailendra Singh Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Chandra Prakash Tiwari Counsel for Respondent :- G.A.
Hon'ble Bala Krishna Narayana,J. Hon'ble Ravindra Nath Kakkar,J.
The petitioner is named in the F.I.R. which has been registered under Sections 147, 323, 504, 506, 392 and 307 I.P.C. in Case Crime No. 341 of 2018 at Police Station Kotwali Nagar (Mahoba), District Mahoba.
It is contended on behalf of the petitioner that the perusal of the F.I.R. would disclose that no serious offence has been made out against the petitioner and the petitioner has been falsely implicated in the matter. Lastly it was urged that the allegation levelled against the petitioner is nothing in fact it is bundle of lies, the prosecution is cock and bull story and having no truthfulness.
We have heard the learned counsel for the parties and perused the record.
Taking into consideration of the allegations and material on record, we are of the view that interest of justice requires following protection to the petitioner:
(i) The petitioner shall not be arrested till 6th August, 2018.
(ii) In meantime, the petitioner may move an appropriate application before the court concerned.
(iii) In the event any such application is moved, we hope that the court concerned shall pass an appropriate order expeditiously in accordance with law.
The writ petition is disposed of. No order as to costs.
Order Date :- 27.7.2018 RPD
