Heard learned counsel for the petitioners; learned Standing Counsel for respondents 1 and 4 and Sri Ramendra Pratap Singh for respondents 2 and 3.
The instant petition has been filed for direction upon the respondents to take a decision on the objections of the petitioners taken to a notice issued under Section 10 of the U.P. Industrial Area Development Authority Act, 1976.
It appears from the record that notices were served upon the petitioners in respect of making development contrary to the provisions of the Act.
The petitioners claim that they have submitted response to the notice but no decision has been taken as yet and therefore they have prayed that a decision may be taken by the authorities concerned.
Considering the innocuous prayer made by the petitioners, Sri Ramendra Pratap Singh, who appears on behalf of respondents 2 and 3, prays that this petition may be disposed of by requiring the authorities concerned to take an appropriate decision on the response submitted to the notice.
Without expressing any opinion on the merits of the allegations and the explanation submitted, we deem it appropriate to dispose of this petition by providing that if the petitioners have already submitted a response to the notice issued to them, they may submit a reminder annexing therewith copy of the response earlier submitted along with certified copy of the order before the authority concerned. Upon receipt of such application, the authority concerned shall endeavour to take an appropriate decision on the said application, preferably, within next eight weeks, in accordance with law.
