The grievance of the petitioners is that the applications made by them for issuance of the Caste Certificate, have been rejected by the Tehsildar.
Learned counsel for the petitioners submits that the Tehsildar has absolutely no jurisdiction to even consider the application for issuance of Caste Certificate inasmuch as vide Government Order dated 28.2.2011, it is the District Level Committee headed by the District Magistrate, which is the competent authority to consider the application.
Learned Standing Counsel does not dispute this proposition.
In such circumstances, the impugned order dated 27.5.2017 issued by Tehsildar, Bidhuna in respect of petitioners rejecting their applications, is set aside and the issue stands remitted back to be placed before the District Level Caste Scrutiny Committee to consider the applications of the petitioners, in accordance with law and pass appropriate orders thereon within a period of four weeks from the date of production of a certified copy of this order.
The writ petition is allowed.
