1. Called in revise. None appeared on behalf of petitioners.
2. By means of the present writ petition, petitioners have sought the following reliefs:
“issue a writ, order or direction to the respondents to implement the judgment and order dated 18.1.93 passed by this Hon'ble Court in writ petition No. 29290/1990 Ramesh Upadhyay Vs. State of U.P. & others reported in 1993 Vol. I, ESC Page 360 in case of the present institution and all profits and consequential benefits may be provided accordance with the decision of Ramesh Upadhyay case from the date of the appointment of the teachers in Primary Section.”
3. However, I have gone through the pleadings, grounds as also reliefs sought and find that petitioners are not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or that petitioners have lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioners is absent.
5. Dismissed. Interim order, if any, stands vacated.
