This writ petition is filed for a mandamus declaring the action of the respondents in not permitting the petitioner to distribute essential commodities to the cardholders by delivering the same to the petitioner’s fair price shop No.3, Ginjupalli village, Atchampet Mandal, Guntur District as illegal and arbitrary.

The case of the petitioner is that she was appointed as Fair Price Shop dealer for Shop No.3, Ginjupalli village, Atchampet Mandal, Guntur District in the year 1993 and has been distributing essential commodities to the cardholders without any complaint since then and her authorisation is being renewed from time to time valid up to 31-03-2015. It is stated that though the authorisation of the petitioner is valid and subsisting, the respondents are not supplying the stocks to the petitioner. Aggrieved by the same, the present writ petition is filed.
3. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Civil Supplies.
4. Having regard to the facts and circumstances of the case and since it is stated that the authorisation of the petitioner is valid and subsisting, the respondents cannot deny supply of stocks to the petitioner’s fair price shop.
5. In view of the above, the respondents are directed to supply the stocks to the petitioner’s fair price shop as long as her authorisation is valid and subsisting. However, this order will not preclude the competent authority-the 2nd respondent from taking appropriate action in case the petitioner has committed any violation of Control Order, 2008.
With the above direction, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
