THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.20345 of 2014 ORDER :
The grievance of the petitioner is that the 3rd respondent is refusing to receive the deed of conveyance at the threshold concerning the land to an extent of 160 square yards in Survey No.11 of Dondaparthy Village, Railway New Colony, Visakhapatnam.
2. Learned counsel for the petitioner submits that the Sub-Registrar ought not to have refused to receive and process the deed of conveyance.
3. Having regard to the aforesaid submissions, this Writ Petition is disposed of granting liberty to the petitioner to present the deed of conveyance before the Sub-Registrar. As and when such deed of conveyance is presented, the Sub-Registrar shall receive and process the same in accordance with Indian Registration Act, 1908 and the Indian Stamp Act, 1899. If the Sub-Registrar has valid reasons in refusing to register the deed of conveyance, he shall pass orders under Section 71 of the Registration Act and communicate the same to the petitioner within a period of two weeks from the date of receipt of such application. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
