ORDER:
This Writ Petition is filed for a Mandamus to declare the action of respondent No.2 in not passing orders on the stay application filed by the petitioner in the appeal filed by him against order, dated 04.10.2014 of respondent No.3, whereby he has suspended the petitioner’s fair price shop authorization.
Inasmuch as the enquiry is pending before respondent No.3, I am of the opinion that it will be a futile exercise on the part of the petitioner to pursue the appeal before respondent No.2. Instead, I feel it appropriate that respondent No.3 completes the enquiry and passes a final order expeditiously.
Accordingly, respondent No.3 is directed to complete the enquiry and pass a final order. While holding enquiry, he shall follow the procedure explained by this Court in B.Manjula Vs. District Collector, Civil Supplies, Kurnool (Writ Petition No.32713 of 2011, dated 26.11.2014), (copy of which is enclosed), complete the same and pass a final order within one month from the date of receipt of a copy of this order.
Subject to the above direction, the Writ Petition is disposed of.
As a sequel to disposal of the Writ Petition, W.P.M.P.No.48964 of 2014 filed by the petitioner for interim relief is disposed of as infructuous.
