Gopal Das, presented this writ petition under Article 226 of the Constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court will be pleased to issue a writ or order or direction more in the nature of writ of Mandamus declaring the action of the second respondent in issuing the impugned Memo No. R1/1586/2008, dated 13.05.2010 demanding the petitioner to pay Rs. 4,79,063/- towards regularization charges for regularizing the petitioner land to an extent of 70 sq. yds., situated at D/No. 10-5-2/1/3/5/A, Mallepally Village, as illegal, arbitrary, unjust and against G.O.Ms.No. 166 Revenue ( Assn. POT) Department , dated 16.02.2008 and consequentially direct the second respondent to reduce the amount towards regularization charges for regularizing the petitioner land to an extent of 70 sq. yds., situated at D/No. 10-5-2/1/3/5/A, Mallepally Village, as per the market value informed by the Sub-Registrar, Golconda Vide Letter No. 250 /SRO/GO1/2010, dated 18.10.2010 fixed market value of Rs. 4,900/- per square yard without adding 25% surcharge .
AND WHEREAS the High Court upon hearing the arguments of Sri P. .Gopal Das, Advocate for the Petitioner and of G.P. for Revenue for the Respondents directed issue of notice to the Respondents herein to show cause why this writ petition should not be admitted in the circumstances set out in the petition and the affidavit filed in Writ Petition.
