ORDER:
This Writ Petition is filed with the grievance that respondent No.3 has not been allotting the essential commodities to the petitioner’s fair price shop though her fair price shop authorization is subsisting till 31.03.2015 and that instead, he has been allotting the essential commodities to respondent No.4 which does not hold any authorization.
At the hearing, learned Assistant Government Pleader for Civil Supplies (Andhra Pradesh) submitted that he has spoken to respondent No.3 and that he was cautioned by respondent No.2 and also the Joint Collector, Guntur District not to repeat such conduct. He has further submitted that as the essential commodities for the month of December, 2014 were already allotted to respondent No.4, respondent No.3 will resume allotment of essential commodities to the petitioner’s fair price shop from the month of January, 2015.
Though this Court is satisfied that respondent No.3 has unlawfully withheld the essential commodities to the petitioner’s fair price shop, in view of the request made by learned Assistant Government Pleader to take a lenient view of the illegal action committed by respondent No.3 for once, I refrain from giving directions for taking action against respondent No.3. However, he is warned not to repeat such conduct in future.
The Writ Petition is, accordingly, disposed of.
As a sequel, WPMP.No.46669 of 2014 is disposed of as infructuous.
