Order:
This Contempt Case is filed alleging willful disobedience of Order, dated 09-10-2013, in WP.No.29302 of 2013, by the respondent.
Upon finding a prima facie case against the respondents, this Court has admitted the Contempt Case on 21-11-2014 and directed their appearance. All the three respondents have, accordingly, appeared before this Court on 23-04-2014. During the hearing, the respondents have admitted their mistake in passing the orders, which are in conflict with the view expressed by this Court in Order, dated 09-10-2013, in WP.No.29302 of 2013. On the request made by the learned Special Government Pleader for a short adjournment for filing appropriate affidavits by the respondents, the case was adjourned to today.
Today, all the three respondents are present. Respondent Nos.1 and 2 have filed separate affidavits. In his affidavit, respondent No.1 has expressed remorse for passing the order contrary to the order of this Court. He has also enclosed proceeding, dated 23-12-2014, whereby he has withdrawn the earlier order passed by him. Respondent No.2 has also tendered apology on behalf of his predecessor (respondent No.3 herein), who has passed the earlier order contrary to the view taken by this Court and has also issued separate proceeding, dated 23-12-2014, withdrawing the said order and undertaking that he will hold an impartial enquiry into the claim of the petitioners and pass a fresh order in accordance with law.
In the light of the above facts and the expression of penitence by the respondents, the respondents are discharged from the contempt proceedings and the Contempt Case is closed with the direction to respondent No.2 to hold a fresh enquiry and pass a fresh order in the light of the view expressed by this Court in Order, dated 09-10-2013, in WP.No.29302 of 2013.
