HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.30665 OF 2014 ORDER:
Alleging that respondents are taking possession and utilizing the land for the purpose of widening of National Highway, this writ petition is instituted. No material is filed in support of the contention that such action was taken by the respondent authorities.
2. On instructions, learned Assistant Government Pleaders submit that stretch from Macherla to Srisailam Road from KM 37/846 to 78/100 was handed over to (R&B) National Highway Department on 26.05.2014. It is at the stage of earmarking. No notification was issued under Land Acquisition Act and petitioner also not impleaded the concerned authorities as respondents, who are actually concerned with the National Highway. None of the respondents impleaded by the petitioner are concerned with the National Highway in the above stretch.
3. Having regard to the submissions of the learned Assistant Government Pleaders, this writ petition is premature and it is accordingly dismissed. There shall be no order as to costs. Miscellaneous petitions if any pending in this writ petition shall stand closed.
