Shaidha Begum vs The General Manager

Madras High Court|06 June, 2017

JUDGMENT / ORDER

The petitioner has filed this writ petition seeking to direct the respondents to conduct a detailed enquiry and dispose of his representation dated 10.08.2015 on merits.
2. Learned counsel for the petitioner submitted that the petitioner availed a mortgage loan of Rs.8,00,000/- by way of deposit of title deed of her house property, from the 1st respondent Bank in the year 2001. During the year 2006-07, the Government announced an Interest Reduction Scheme giving 25% reduction in interest, if the dues are settled. The petitioner remitted a sum of Rs.1,50,000/- to avail the scheme. On 27.05.2015, the petitioner received an auction notice dated 27.05.2015 from the 2nd respondent, showing an outstanding amount of Rs.34,12,174/-. Hence, the petitioner paid a sum of Rs.5,00,000/- on 14.07.2015. According to the petitioner, the 1st respondent has not taken into account the amounts paid by her till such date and was not extended with the benefit of the Interest Reduction Scheme. Explaining the above situation, the petitioner submitted a representation dated 10.08.2015. Since no action was taken by the respondents, the petitioner has filed this Writ Petition with the aforesaid prayer.
3. Learned counsel for the respondents would submit that the said representation would be considered in accordance with law, by considering the facts and circumstances of the case.
4. Considering the limited scope of the prayer in this writ petition, without going into the merits of the case, the 1st respondent is directed to dispose of the representation dated 10.08.2015, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. It is needless to state that the petitioner shall submit a copy of this order, along with a copy of her representation to the 1st respondent.
5. The writ petition is disposed of, with the above direction. Consequently, the connected M.P is closed. No costs.
