By means of the order dated 23.12.2009, this Court granted four weeks' time for filing counter-affidavit and thereafter, one week was granted to file rejoinder. It was also provided that the application for interim relief will be considered after filing the counter-affidavit.
As the counter-affidavit has not been filed, the application for interim relief cannot be considered today.
However, in the ends justice of justice, 15 days' time is granted to the learned Standing Counsel to comply with the order dated 23.12.2009. In case, counter-affidavit is not filed by the next date of listing, the Superintendent of Police, Chandauli (now presently known as Sant Ravidas Nagar) shall appear in person to assist the Court on the next date of listing.
