The orders of rejection of grant of gun license for a second gun fire arm as applied by the petitioner are being challenged on the ground that the D.B.B.L. gun, licence of which has been granted in favour of the petitioner, is not functioning properly. Submission is that the petitioner, therefore, needs a fresh fire arm license so as to purchase N.P.B.Rifle.
This submission of learned counsel for the petitioner cannot be made basis to assail the orders impugned.
It is open for the petitioner to move a fresh application seeking redressal of his grievances before the appropriate authority. In case of any such application moved on the pleadings noted above, the licensing authority would be under obligation to take an independent decision .
The present petition, is accordingly, disposed of.
