This Application U/S 482 Cr.P.C. has been filed with the prayer to quash the non bailable warrant dated 23.9.2019 passed by the Chief Metropolitan Magistrate, Kanpur Nagar in case no. 42732 of 2018 (State Vs. Shahnawaz and others) arising out case crime no. 940 of 2017, under Sections 498-A, 323, 504, 506 IPC and Section 3/4 D. P. Act, Police Station Chakeri, district Kanpur Nagar pending in the court of Chief Metropolitan Magistrate, Kanpur Nagar. Further prayer has been made to stay the operation and effect of the aforesaid non bailable warrant.
Applicant was on interim bail. On the date fixed in the matter he did not appear and exemption application was moved which was rejected and the court concerned vide impugned order issued non bailable warrant against the applicant. After hearing the parties and going through the entire record, process adopted by the Court below cannot be termed to be illegal.
Prayer made in the application cannot be allowed. The application is dismissed.
