Heard learned counsel for the applicant and Sri Pranjal Mehrotra, who has appeared on instructions of the opposite party.
A writ petition preferred by the applicant seeking consideration of her claim for appointment on compassionate grounds was disposed of with a direction to the competent authority in K.E.S.C.O. to decide the claim. The Court also noted the existence of a competing claim set up by one Farida Anjum.
Sri Mehrota on instructions points out that not only is there a dispute with regard to the actual date of death of the deceased employee, despite repeated communications addressed to the applicant as well as the other claimant they have not come forward in response to the notices issued. He has also placed for the perusal of the Court the notices sent in this regard along with postal receipt. Since the applicant herself has not approach the competent authority in K.E.S.C.O., this Court finds no ground to initiate proceedings in contempt.
The petition is consequently dismissed.
This order however shall not preclude the applicant from complying with the directions issued by the writ Court if she is still desirous of her claim for appointment being considered.
