The applicant is before this Court for a direction to initiate contempt proceeding against the opposite party for wilful disobedience of the judgement and order dated 13.10.1987 passed in Second Appeal No.844 of 1986 (Khuda Baksh and others Vs. Mohd. Shamim Khan and others).
After some arguments a prayer has been made by counsel for the applicant to dismiss the present contempt petition with liberty to file application in the pending second appeal as provided under Section 39 Rule 2(A) CPC.
Prayer is allowed.
The present contempt petition is dismissed with liberty as prayed.
