None responds for the petitioner to press this writ petition.
Heard learned Standing Counsel and perused the record.
The petitioner who is tenure holder of plot Nos. 544(Ga) measuring 6-12-0, 625 measuring 2-0-0, 624 measuring 3-3-0, 711(Ga) measuring 2-0-0 which is situated in village Malesha Mau, Pargana Tehsil and District Lucknow, subjected the acquisition proceeding under the Land Acquisition Act and compensation was not paid, the instant writ petition has been filed with the prayer to direct the opposite parties to declare the award under Section 11(2) of the Land Acquisition Act and to pay the compensation to the petitioner as earliest possible.
It has been submitted that the petitioner's land is an agricultural land and the entire family depends upon the produce of agriculture.
Accordingly, without entering into the merits of the case, we direct the opposite parties that if the petitioner is entitled for payment of compensation, the same may be paid, if there is no other legal impediment.
With the aforesaid observation, the writ petition is finally disposed of.
