1. This petition has been filed for seeking transfer of Original Suit No. 799 of 2012, pending in Court of Senior Judge, Civil Court, Bareill. Learned counsel for petitioners has sought a mandamus directing respondent No.2 i.e. Registrar General, High Court, Allahabad to transfer the said case or dispose of the said suit as early as possible.
2. Registrar General does not exercise any judicial power at all. In respect of suits pending in Civil Court, if transfer is prayed for, and sufficient grounds are made out, it is permissible under section 24 C.P.C. so far as the question of decision of suit is concerned, it is also for Court concerned not by Registrar General.
3. Writ petition is thoroughly misconceived and deserves to be dismissed with cost.
4. Dismissed accordingly with cost quantified as Rs. 5,000/-.
