Counsel for the petitioner states that in compliance of order dated 17.1.2019, he has duly served a notice upon Secretary, U.P. Basic Shiksha Parishad, Allahabad. A copy of the covering letter bearing endorsement from the office of the said respondent is shown to the Court. However, no one has appeared on behalf of respondent Nos. 2 & 3.
The writ petition has been filed seeking a direction to the respondent authority to release G.P.F. amount of Rs. 14,26,625/- along with interest to the petitioner forthwith. The petitioner, claims to be working as Assistant Teacher in Jame-Ul-Uloom Junior High School, Khatauli, Muzaffarnagar. She took voluntary retirement on 31.7.2018. Her grievance is that the GPF amount payable to her upon retirement has not been released in her favour so far. She has met the Finance & Accounts Officer and Basic Education Officer and prayed for release of GPF amount, but no heed was paid to the same.
In the opinion of the Court, no useful purpose will be served in keeping the matter pending.
The writ petition is disposed of by granting liberty to the petitioner to approach respondent No. 2 with a fresh representation and certified copy of this order and in which event, respondent No. 2 himself or in case, the decision is required to be taken by respondent No. 3, shall decide the representation of the petitioner for payment of GPF amount expeditiously, preferably within a period of eight weeks from the date of communication of the order along with fresh representation.
