HONOURABLE SRI JUSTICE S.RAVI KUMAR TRANSFER C.M.P.No.141 of 2013 ORDER:
This petition is filed to withdraw O.S.No.16 of 2013 from the file of Junior Civil Judge, Devarakonda and transfer the same to Family Court, Hyderabad for disposal in accordance with law.
Petitioner herein is the defendant in the above referred suit and she is wife of plaintiff.
Advocate for petitioner submitted that wife filed Maintenance Case before Family Court, Hyderabad and the respondent herein is attending in the said case. He also submitted that wife filed D.V.C. and the same is pending before X Metropolitan Magistrate, Malkajgiri, and he is also appearing in that case. He further submitted that as a counter blast to harass the petitioner-wife, he filed the present suit before the Junior Civil Judge, Devarakonda and submitted that the marriage was performed at Hyderabad and petitioner is a resident of Cherlapalli, Hyderabad and it will be very difficult for her to travel all the way from Hyderabad to Devarakonda for the purpose of this case and that as the respondent-husband is attending the court at Ranga Reddy, it will be convenient for both the parties, if the matter is transferred to Ranga Reddy court.
Respondent though served with notice, did not appear.
Considering the submissions of the learned counsel for the petitioner and the affidavit averments of the petitioner, O.S.No.16 of 2013 is withdrawn from the file of Junior Civil Judge, Devarakonda and transferred to the file of the Family Court, Ranga Reddy to be tried along with M.C. pending there filed by the wife.
This Transfer C.M.P. is allowed accordingly.
As a sequel to the disposal of this Transfer C.M.P., the Miscellaneous Petitions, if any, pending, shall stand dismissed.
