The sole relief claimed in the instant petition is for issuing direction to the executing court to conclude the proceedings registered as Misc. Case No.49 of 2012 under Order 21 Rule 32 read with Section 151 CPC within a time specified by this Court.
The petitioners are holder of decree of permanent injunction in Original Suit No.50 of 1977. The said decree has been put to execution. A perusal of the order sheet reveals that the judgement debtors have been duly served in the said proceedings either by refusal or by publication.
Having regard to the entire facts of the case and the submissions made, the instant petition is disposed of by directing the executing court to make all endeavour to decide the proceedings expeditiously, without granting unnecessary adjournments.
