Heard Sri Mata Achal Mishra, learned counsel for the petitioner and Ms. Maimoona Fatima holding brief of Sri Mahboob Ahmad, learned counsel for respondents no. 1 to 3.
The petitioner in the writ petition is seeking quashing of the demand notice dated 27.03.2019 whereby she has been directed to deposit a sum of Rs.1,37,142/-.
The facts of the case are that on 6.2.2019 the petitioner was issued a notice for depositing Rs.38,884/- towards electricity dues which she promptly deposited on the very next day i.e. 7.2.2019, copy of receipt has been filed as annexure-2 to the writ petition.
Contention of the learned counsel for the petitioner is that when the arrears were computed at Rs.38,884/- on 6.2.2019 then how it was inflated to Rs.1,37,142/- on 27.3.2019. Learned counsel for the petitioner submits that the petitioner has submitted her objection before the authority on 1.4.2019 by registered post, annexure-9 to the writ petition.
No useful purpose would be served by keeping this writ petition pending.
The writ petition is disposed of with a direction that if the petitioner appears before the respondent no. 2, Executive Engineer, Electricity Urban Distribution Division, Kalyani Devi, Allahabad on 9.5.2019 at 11 a.m. along with a copy of her representation, the respondent no. 2 shall hear the petitioner and thereafter, decide her objection in accordance with law within a further period of fifteen days.
